Canada Is Home, But Your Marriage May Still Be Governed By Indian Law

Canada has one of the largest Indian communities in the world, with many families on study permits, work permits, permanent residence or citizenship. Marriages are often arranged or registered in India, and families on both sides can be drawn into a dispute.

We begin by listening, then explain how Indian and Canadian courts will each see your situation. Many of our Canadian clients simply want to know whether to file, wait or settle, and what each choice means for their status and their children.

The Legal Position For Indians In Canada

Under Canadian law, divorce is a federal matter under the Divorce Act, with a court asking whether the marriage has broken down, often shown by a period of separation. Property, support and child arrangements are decided under provincial rules, so the answer can differ between Ontario, British Columbia and Alberta.

A marriage registered in India under Indian law still needs to be ended in a way India accepts if you plan to remarry in India, hold property here or return. Canada is not a notified reciprocating territory, so a Canadian decree is normally tested in India through a suit on the decree rather than executed directly.

How We Run Your Case From India

  1. 100% confidential consultation at a time that suits you. We speak by phone, WhatsApp or video, and plan around your time zone (Canada runs 9.5 to 13.5 hours behind India).
  2. Fix the right forum. We study where you married, where you last lived together and where your spouse lives, to decide whether the Indian court, the court in Canada, or both are in play.
  3. Power of attorney and documents. You sign a power of attorney and have it signed before a Canadian notary public and apostilled where required, or attested at the High Commission of India or a consulate. We tell you exactly which documents to sign and how to send them.
  4. Filing and hearings in India. We file and appear for you. Where the court permits, you join key hearings by video from Canada.
  5. Settlement or trial. If a settlement is possible, we draft it carefully. If not, we prepare the evidence and argue the case on its merits.
  6. Decree and recognition. We obtain certified copies and help you use the decree in Canada, with advice on recognition and, where needed, on executing a foreign decree in India.

Documents To Keep Ready

  • Passport, visa or residence permit and a copy of your permanent resident card, work permit or study permit of both spouses
  • Marriage certificate and wedding photographs
  • Address proofs in India and in Canada
  • Messages, emails and call records relevant to the dispute
  • Income, bank and tax records if maintenance is an issue
  • Birth certificates and school records of any children

Points To Keep In Mind

  • Do not sign settlement papers or consent documents without legal advice, even if they look routine.
  • Keep your work permit, study permit or PR papers handy. A separation can affect a sponsored spouse, so take immigration advice alongside ours.
  • Tell us if there are children, because school, passport and custody questions need early planning.
  • If you are being threatened with a criminal case or a lookout circular, tell us at once so we can plan travel safely.
  • Choose consultation times that suit your Canadian time zone, from Eastern to Pacific.
Foreign and Indian decrees are not always interchangeable. Indian courts recognise a foreign divorce decree only if it meets certain tests, such as proper jurisdiction and a decision on the merits under the law that governed the marriage (Y. Narasimha Rao v. Venkata Lakshmi, 1991). Always get advice before relying on a divorce obtained abroad.

Typical Timeline For An NRI Case From Canada

  1. Week 1: consultation by phone or video at a time that suits you, and a review of your documents.
  2. Weeks 2 to 4: drafting of the petition or reply, and preparation of the power of attorney.
  3. Weeks 4 to 8: original documents reach us and the case is filed, or the reply is submitted in the Indian court.
  4. Months 2 to 6: hearings and, in contested cases, evidence. A mutual consent case can be much shorter when the court waives the cooling-off period.
  5. Final stage: the decree is passed and we obtain certified copies you can use in Canada.

Toronto, Vancouver And Sponsored Spouses

Many disputes involve a spouse sponsored to Canada or a student who married before leaving India. Pressure from family on both sides, fears about immigration status and concerns about children can make it difficult to act calmly. We coordinate with your Canadian lawyer so that your Indian case, your Canadian filings and any immigration steps are aligned, and so that you do not sign anything that leaves you exposed.

Illustrative Situations

General examples only. Every case depends on its own facts.

A spouse in Brampton wants out of an arranged marriage. A client in Brampton had married in Punjab and moved to Canada. We filed a mutual consent petition in Delhi through a power of attorney and arranged for her to appear by video.

A husband in Vancouver receives a court notice. He had not understood the notice from India. We replied on time, protected his position and advised him on safe travel to India.

A mother wants a child to stay in Canada. We advised on custody and travel questions and prepared the case for the Indian court to consider her child’s circumstances.

Frequently Asked Questions

Your Questions Answered

Straight answers to what clients ask us most often.

Ask Us Directly
Can I get a mutual divorce in India while living in Canada?

Yes. Many NRIs complete a mutual divorce in India through a power of attorney and video appearance, subject to the court’s permission. Where the court waives the six-month cooling-off period on a waiver application, the case can often be finished in about 30 days.

Will an Indian divorce be valid in Canada?

An Indian decree is generally considered in Canada under its own recognition rules, which may differ between provinces. We advise on the Indian side and recommend confirming Canadian requirements with a local lawyer.

What if my spouse has filed a case in Canada?

A Canadian case does not automatically stop your Indian case. The question is which court has proper jurisdiction and which decree can be enforced. We assess both and plan a response before you reply or file.

Do I need to be in Delhi for the hearings?

Not always. Where the court permits, you can appear by video link from Canada, and your advocate appears for you under a power of attorney. Some stages, such as recording statements in a mutual consent case, may need you to appear once, and we plan this around your visa and work.

How do I get a power of attorney ready in Canada?

Sign the power of attorney before a notary public in Canada. It is then apostilled, as Canada now issues apostilles, or attested by the High Commission of India or a consulate, depending on the requirement. We confirm the route before you sign.

Is a Canadian divorce decree valid in India?

Only if it passes the tests of Indian law. Canada is not a reciprocating territory, so a Canadian decree is normally tested in India through a suit on the decree, after which the court can give effect to it by executing the foreign decree in India. The court examines the decree first.

Can a domestic violence case be filed in India against an NRI husband or his family?

Yes. Under the Protection of Women from Domestic Violence Act, 2005, a woman can ask an Indian court for protection, residence and monetary relief where she lives or has lived in a shared household, even if the husband now lives abroad. If you are the respondent, you can reply through an advocate and a power of attorney, so please contact us early.

Can I be arrested at the airport because of an Indian case?

A lookout circular or arrest warrant is possible in some criminal matters, such as 498A complaints, but it is not automatic. Early advice on anticipatory bail, quashing and travel planning matters, so contact us before you fly to India if a complaint has been filed.

Is my case kept confidential?

Yes. All consultations and documents are kept strictly confidential, and we only share them with the court and the people who need them for your case.

Can my children stay with me in Canada during the case?

This depends on the child’s residence, the orders of the court and the facts. Taking a child out of Canada or keeping a child in India without agreement can create serious problems, so please take advice first.
