An FIR Or Police Notice Can Turn A Normal Day Into A Crisis
One phone call from the police station, one notice from a court or one FIR copy forwarded on WhatsApp is enough to make your heart race. You may worry about arrest, your job, your passport, your parents’ reputation and the neighbours’ reactions. Many of the cases we see begin as family disputes, such as dowry allegations, cruelty complaints or disputes over money, that then take a criminal form.
The first days are the most important. What you say, sign and do can shape the whole case, so it pays to speak to an advocate before going to the police station.
Criminal Matters We Handle
- Anticipatory bail: asking the court for protection from arrest before it happens, under Section 482 of the BNSS (earlier Section 438 CrPC).
- Regular bail: applying for release after arrest, in the Magistrate or Sessions Court.
- Quashing of FIR or proceedings: asking the High Court to cancel proceedings that are baseless, exaggerated or settled, under its inherent powers in Section 528 of the BNSS.
- 498A and dowry cases: defence and complainant representation, as explained on our 498A page.
- Cheque bounce cases: complaints and defence under Section 138 of the Negotiable Instruments Act.
- Trial defence: cross-examination, evidence and arguments before the Magistrate or Sessions Court.
What To Do If You Receive A Police Notice
- Do not ignore it. Note the date, time and the police station mentioned.
- Call a lawyer before you go. You have the right to legal advice.
- Carry ID and relevant documents, but do not sign anything blank.
- Do not make statements out of anger or fear. Keep them accurate and brief.
- Ask about anticipatory bail if arrest is a real risk.
Cheque Bounce: Know The Timelines
If a cheque is dishonoured, the payee must send a written demand notice within 30 days of receiving the bank’s memo. The drawer then has 15 days to pay. If payment is not made, the complaint must be filed within one month after that period ends. Missing any step can end the complaint, so act quickly, whether you are the complainant or the accused.

Your Rights During Police Questioning
- You have the right to consult an advocate before and, in many circumstances, during questioning.
- You can ask for the reason for any arrest and must be told of the grounds.
- An arrested person must be produced before a Magistrate within 24 hours, excluding travel time.
- You can ask that a relative or friend be informed of the arrest.
- You should not be coerced into signing blank papers or statements you did not read.
Regular Bail, Anticipatory Bail And Interim Protection
Different kinds of relief apply at different stages. Anticipatory bail protects you before arrest. Regular bail applies after arrest or on summons. Interim protection from arrest may be given by a court while it hears your petition. The choice depends on the stage, the allegations and the court you approach, and we tell you which course gives you the best chance. Where several family members are involved, we often apply for them together, but with individual facts for each person.
Illustrative Situations
General examples, not real clients.
A husband summoned after a complaint. He is called to the police station for questioning. We prepare him, accompany him with his written responses and apply for anticipatory bail where there is a risk of arrest.
A cheque issued in a settlement. A cheque given as part of a settlement is dishonoured. We send a legal notice within the statutory time and, if payment is not made, file a complaint.
A family served with a summons. The case against elderly parents is based on general allegations. We seek discharge or quashing by pointing to the lack of specific roles.

Your Questions Answered
Straight answers to what clients ask us most often.
Ask Us DirectlyWhat is anticipatory bail?
It is a court order that protects you from arrest in a non-bailable offence if you apply before arrest, subject to conditions.
Can an FIR be cancelled?
The High Court can quash an FIR or proceedings in suitable cases, such as where allegations are baseless or the parties have settled, depending on the offence.
Should I go to the police station without a lawyer?
It is safer to take advice first, particularly if the allegations are serious.
How long does bail take?
Anticipatory bail can be heard in days, while regular bail depends on the court and the stage of the case.
Do you handle cheque bounce cases?
Yes, for both complainants and accused.
Is my consultation confidential?
Yes, completely.
Can the police search my house without a warrant?
In certain circumstances they can, but there are rules and safeguards. Ask for identification and the grounds of the search and call your advocate.
How long can the police keep me in custody?
Police custody is limited and supervised by a Magistrate. The law sets time limits and conditions.
Can a cheque bounce complaint be settled?
Yes. The offence is compoundable with the court’s permission, and many cases end with payment and settlement.
