One Problem, Several Laws: How To Choose Where To Start
If you are facing abuse, insults, threats, controlled finances or dowry harassment at home, you may be told many different things. One person says to file a police complaint. Another says to go to the Family Court. A third says to wait. The truth is that Indian law offers several remedies, each with a different purpose, and the right order depends on your safety, your finances and your goals.
If you are in immediate danger, call the police on 112 or the Women Helpline on 181. Safety comes before any legal step.

How The Cases Affect Each Other
- Facts and evidence carry across. A medical report or message used in one case can be relevant in another, so your statements must be consistent.
- Domestic violence can support divorce. Abuse can be proved as cruelty, which is a ground for divorce.
- Custody follows welfare. A history of violence affects what arrangement is safe for the child.
- Maintenance can be claimed in more than one forum, but courts consider earlier orders to avoid double recovery.
The Shared Household: Your Right To Stay
Many women fear being thrown out of the only home they have. Under the Domestic Violence Act, a woman has the right to reside in the shared household, whether or not she has any title to it. In Satish Chander Ahuja v. Sneha Ahuja (2020), the Supreme Court gave a wide meaning to “shared household”, which can include a home belonging to relatives where she lived as part of the domestic relationship. The court can restrain eviction, order the abuser to leave or provide alternate accommodation.
A Practical Safety And Evidence Plan
- Keep important documents, IDs, bank details and a small amount of money in a safe place.
- Save messages, photographs and medical records where the abuser cannot delete them, for example with a trusted person.
- Note dates, places and witnesses of each incident.
- Tell a trusted friend or relative about your situation.
- Speak to an advocate in confidence before you leave or confront the abuser.

Illustrative Situations
General examples, not real clients.
A woman who needs urgent shelter. She files a protection application and, with a Protection Officer’s help, seeks interim residence and maintenance orders while she stays in a safe place.
A couple with several overlapping cases. The wife has filed a domestic violence case and a maintenance case, and the husband has filed for divorce. We coordinate evidence and statements so that they are consistent across cases.
A mother-in-law named in the complaint. The complaint contains general allegations. We help her respond to the specific claims and ask the court to exclude any unsupported allegations.
Choosing Between Civil And Criminal Remedies
Civil remedies, such as protection orders and maintenance, focus on safety and support and usually move faster. Criminal remedies focus on punishment and may take longer. Some women prefer the civil route because it lets them stay in the home and seek money without a prolonged criminal case. Others choose the criminal route because the abuse was serious or dangerous. In some cases, both routes are used. We explain the pros and cons without pressure so that you decide on your own terms.

Frequently Asked Questions
Your Questions Answered
Straight answers to what clients ask us most often.
Ask Us DirectlyWhich should I file first, a police case or a domestic violence case?
It depends on safety, evidence and your goals. A protection application is civil and focuses on safety and support, while a police complaint begins a criminal case. We discuss the best order with you.
Can I file for divorce and domestic violence together?
Yes. They are separate proceedings in different courts, and they can run at the same time.
Will I lose my home if I file a case?
No. The Act protects your right to reside in the shared household, and the court can restrain eviction.
Does domestic violence affect child custody?
Yes. Courts consider safety and welfare, so a proven history of violence can affect custody and visitation.
What if the allegations against me are false?
Do not ignore notices. We examine the complaint, challenge exaggerated or unsupported claims and defend you.
Is my consultation confidential?
Yes. Every consultation is 100% confidential.
Can I withdraw a domestic violence case?
You can ask the court for permission to withdraw or settle, and the court will examine whether it is voluntary.
What if my husband threatens me after I file?
Report it immediately to the police and tell your advocate. A breach of a protection order is an offence.
Do I need to hire a lawyer for a domestic violence case?
You can approach the Protection Officer or the court directly, but a lawyer helps with drafting and evidence.
