When Your Case Has To Go Beyond Delhi

Some family disputes cannot be solved in one city. Your spouse may have filed a case in a faraway state to make it hard for you to defend, or an important legal question may need to be settled by the highest court. For these situations, the Supreme Court offers remedies that no other court can give.

Going to the Supreme Court is serious, expensive and time-sensitive, and it is not right for every case. We tell you honestly whether it makes sense, what it can realistically achieve and what the alternatives are.

About Supreme Court of India

The Supreme Court of India is at Tilak Marg, New Delhi 110001, and the nearest metro station is Supreme Court (Pragati Maidan) on the Blue Line. In family matters it commonly hears transfer petitions under Section 25 of the Code of Civil Procedure, special leave petitions against High Court judgments, writ petitions and, in appropriate cases, requests to dissolve a marriage using its powers under Article 142.

In Shilpa Sailesh v. Varun Sreenivasan (2023), a Constitution Bench held that the Supreme Court can dissolve a marriage under Article 142 where it is irretrievably broken, and can also waive the cooling-off period in mutual consent cases. This power is used sparingly.

Areas We Commonly Cover

We act for clients across India and abroad in Supreme Court matters, working with advocates-on-record where required. Typical clients include spouses who need to transfer a case filed against them in another state to a convenient court, and families who are challenging High Court orders on maintenance, custody or cruelty.

Jurisdiction depends on the facts. Which court can hear your case turns on the police-station area, where you married, where you last lived together and where you live now. We confirm this before filing so your case is not delayed or returned.

Family Matters We Handle For Supreme Court Clients

Whether your case begins here or is transferred, we represent you from the first consultation to the final order. Our work includes:

What To Expect On Your Hearing Days

  • Share the full set of orders and pleadings from the lower courts, because the Supreme Court works largely from the record.
  • Tell us the exact dates of the judgment and any dates for compliance, since limitation periods are short.
  • For transfer petitions, collect proof of the difficulties you face, such as distance, health, safety, childcare or employment.
  • Be ready for brief hearings, and for the Court to refer the parties to mediation.
  • Understand the costs before starting, and weigh them against the relief you can realistically obtain.

Why Clients Choose S.S Associates

Types Of Family Matters Before The Supreme Court

  • Transfer petitions under Section 25 of the Code of Civil Procedure, to move a case from one state to another.
  • Special Leave Petitions under Article 136, against High Court judgments in appeals or revisions.
  • Writ petitions under Article 32, for enforcement of fundamental rights in exceptional matters.
  • Dissolution of marriage under Article 142, in rare cases where the marriage has irretrievably broken down.

How Transfer Petitions Usually Work

Transfer petitions are filed when a spouse has to defend a case in a faraway court and can show real hardship. The Court looks at factors such as the distance, the safety of the petitioner, the presence of young children, the health of the parties and the convenience of witnesses. Because transfer petitions are heard by benches that handle large lists, they must be drafted precisely, with the cause of hardship explained in a few clear paragraphs and supported by documents.

The Mediation Option At The Supreme Court

The Supreme Court has its own Mediation Centre, and it often sends matrimonial cases for mediation before deciding them. Many parties settle at this stage, and the Court then passes orders on the basis of the settlement, sometimes even dissolving the marriage and closing related cases in a single order. We prepare clients for mediation so that they understand which terms are acceptable and which are not.

Illustrative Situations

General examples, not real clients.

A wife with a young child. Her husband filed for divorce in another state. She seeks transfer of the case to Delhi, where she lives with her family and works.

A couple with several cases. They have civil and criminal cases in different states. They settle in mediation, and the Court passes a consolidated order closing all cases.

A challenge to a High Court order. A party believes the High Court decided a legal question wrongly and files a Special Leave Petition, which is admitted only if the Court finds a substantial question of law.

Mutual consent divorce in about 30 days. Under Indian divorce law, where the court waives the six-month cooling-off period, a mutual consent divorce can be completed in about 30 days. In special cases, a divorce can be filed before one year of marriage, with special circumstances, by using Section 14 of the Hindu Marriage Act. Read more about mutual consent divorce.

In exceptional cases, yes, under Article 142 where the marriage has irretrievably broken down, as the Constitution Bench explained in 2023.

Transfer petitions are often decided within months, while appeals can take longer depending on the listing and the court workload.

Do I have to attend the Supreme Court personally?

Generally not. Your advocate-on-record and counsel appear. You may be asked to attend if the Court refers the matter to mediation.

Is going to the Supreme Court always necessary?
