When Your Marriage And Your Family Are In Two Countries
Many British Indian families keep close ties to India: a marriage held in Delhi or Punjab, parents who live here, property back home. When the marriage ends, those ties mean that a divorce in England may not be the end of the story.
We help you understand what an Indian court can decide that a UK court cannot, and the reverse. That clarity matters before you sign a consent order, accept a financial settlement or leave a case in India undefended.
The Legal Position For Indians In the UK
A marriage registered in India stays valid in India whatever happens in the UK. The UK allows no-fault divorce, and an order granted by a UK court is treated as a foreign decree in India. Indian courts then look at whether it meets their tests before accepting it for remarriage, property or inheritance.
The UK is among the countries notified as a reciprocating territory for the purposes of Section 44A of the Code of Civil Procedure. Depending on the nature of the order, this can make it easier to execute certain UK orders in India. We examine each order before advising you.
How We Run Your Case From India
- 100% confidential consultation at a time that suits you. We speak by phone, WhatsApp or video, and plan around your time zone (the UK is 4.5 to 5.5 hours behind India).
- Fix the right forum. We study where you married, where you last lived together and where your spouse lives, to decide whether the Indian court, the court in the UK, or both are in play.
- Power of attorney and documents. You sign a power of attorney and have it signed before a UK notary public and legalised by apostille, or attested at the Indian High Commission or consulate, depending on the requirement. We tell you exactly which documents to sign and how to send them.
- Filing and hearings in India. We file and appear for you. Where the court permits, you join key hearings by video from the UK.
- Settlement or trial. If a settlement is possible, we draft it carefully. If not, we prepare the evidence and argue the case on its merits.
- Decree and recognition. We obtain certified copies and help you use the decree in the UK, with advice on recognition and, where needed, on executing a foreign decree in India.
Documents To Keep Ready
- Passport, visa or residence permit and a copy of your Biometric Residence Permit or share code and National Insurance details of both spouses
- Marriage certificate and wedding photographs
- Address proofs in India and in the UK
- Messages, emails and call records relevant to the dispute
- Income, bank and tax records if maintenance is an issue
- Birth certificates and school records of any children
Points To Keep In Mind
- Do not sign settlement papers or consent documents without legal advice, even if they look routine.
- Keep your immigration status, ILR or citizenship papers ready, because they are often asked for when documents are verified.
- Tell us if there are children, because school, passport and custody questions need early planning.
- If you are being threatened with a criminal case or a lookout circular, tell us at once so we can plan travel safely.
- Choose consultation times that suit UK time, which is 4.5 hours behind India in summer and 5.5 hours behind in winter.

Typical Timeline For An NRI Case From the UK
- Week 1: consultation by phone or video at a time that suits you, and a review of your documents.
- Weeks 2 to 4: drafting of the petition or reply, and preparation of the power of attorney.
- Weeks 4 to 8: original documents reach us and the case is filed, or the reply is submitted in the Indian court.
- Months 2 to 6: hearings and, in contested cases, evidence. A mutual consent case can be much shorter when the court waives the cooling-off period.
- Final stage: the decree is passed and we obtain certified copies you can use in the UK.
London, The Midlands And Cross-Border Property
British Indian families often hold property in India as well as in the UK, so a divorce can involve a share in a house in London and land in Punjab or Gujarat at the same time. We coordinate with your UK solicitor so that financial orders in the UK and your rights in India are considered together, and so that nothing agreed in one country weakens your position in the other.
Illustrative Situations
General examples only. Every case depends on its own facts.
A spouse in Leicester signs a consent order. A client asked us to review a financial consent order that left out his property in India. We advised on the Indian side so that his UK solicitor could include it properly.
A wife in Birmingham files in India for maintenance. The husband was served in India, appeared through a power of attorney and the court passed interim directions after both sides presented their income.
A UK-based husband receives a 498A complaint. We advised him on anticipatory bail, filed for protection and planned his travel to India with the court’s permission.

Frequently Asked Questions
Your Questions Answered
Straight answers to what clients ask us most often.
Ask Us DirectlyCan I get a mutual divorce in India while living in the UK?
Yes. Many NRIs complete a mutual divorce in India through a power of attorney and video appearance, subject to the court’s permission. Where the court waives the six-month cooling-off period on a waiver application, the case can often be finished in about 30 days.
Will an Indian divorce be valid in the UK?
An Indian decree is usually recognised in the UK if the marriage ended in a way the UK accepts, but the UK has its own recognition rules. We advise on the Indian side and recommend confirming the UK rules with your solicitor.
What if my spouse has filed a case in the UK?
A UK case does not automatically stop an Indian case. Courts look at jurisdiction, the place of marriage and where the couple last lived. We assess the position quickly so that you can respond within the time allowed.
Do I need to be in Delhi for the hearings?
Not always. Where the court permits, you can appear by video link from the UK, and your advocate appears for you under a power of attorney. Some stages, such as recording statements in a mutual consent case, may need you to appear once, and we plan this around your visa and work.
How do I get a power of attorney ready in the UK?
Sign the power of attorney before a UK notary public. It is then legalised by apostille from the UK authorities, or attested by the Indian High Commission, depending on the requirement. We tell you which route to follow before you sign.
Is a UK divorce decree valid in India?
Only if it passes the tests of Indian law. Because the UK is a reciprocating territory, certain UK orders can be executed in India under Section 44A of the Code of Civil Procedure, depending on their nature, and a divorce decree can be given effect by executing the foreign decree in India once it is recognised. The court examines each order first.
Can a domestic violence case be filed in India against an NRI husband or his family?
Yes. Under the Protection of Women from Domestic Violence Act, 2005, a woman can ask an Indian court for protection, residence and monetary relief where she lives or has lived in a shared household, even if the husband now lives abroad. If you are the respondent, you can reply through an advocate and a power of attorney, so please contact us early.
Can I be arrested at the airport because of an Indian case?
A lookout circular or arrest warrant is possible in some criminal matters, such as 498A complaints, but it is not automatic. Early advice on anticipatory bail, quashing and travel planning matters, so contact us before you fly to India if a complaint has been filed.
Is my case kept confidential?
Yes. All consultations and documents are kept strictly confidential, and we only share them with the court and the people who need them for your case.
Can my children stay with me in the UK during the case?
This depends on the child’s residence, the orders of the court and the facts. Moving a child to India without agreement or an order can cause legal problems in both countries, so please take advice first.
