A Marriage Dispute Across Two Legal Systems Is Hard To Handle Alone
Many Indian families in the United States are on work visas such as H-1B, with a spouse on H-4, or hold a green card or citizenship. When a marriage breaks down, the stress is multiplied by visa worries, long distances from family and two sets of courts that do not always speak to each other.
Our first step is to slow things down. We explain what an Indian court can decide, what a US family court can decide and how the two can clash, so that you do not file, sign or settle anything that creates a bigger problem later.
The Legal Position For Indians In the USA
A couple who married in India under the Hindu Marriage Act or the Special Marriage Act continue to be governed by Indian law on the validity of the marriage, even after moving to the United States. US courts apply their own state law to divorce, property and child support, which can lead to two cases running at the same time.
If one spouse files in a US state and the other files in India, the key questions are jurisdiction, where the family last lived together and whether the foreign order would be accepted by an Indian court. We map this out before you take the next step.
How We Run Your Case From India
- 100% confidential consultation at a time that suits you. We speak by phone, WhatsApp or video, and plan around your time zone (the USA runs 9.5 to 13.5 hours behind India).
- Fix the right forum. We study where you married, where you last lived together and where your spouse lives, to decide whether the Indian court, the court in the USA, or both are in play.
- Power of attorney and documents. You sign a power of attorney and have it notarised before a US notary and then attested or apostilled as required, or attested by the Indian Embassy or Consulate nearest to you. We tell you exactly which documents to sign and how to send them.
- Filing and hearings in India. We file and appear for you. Where the court permits, you join key hearings by video from the USA.
- Settlement or trial. If a settlement is possible, we draft it carefully. If not, we prepare the evidence and argue the case on its merits.
- Decree and recognition. We obtain certified copies and help you use the decree in the USA, with advice on recognition and, where needed, on executing a foreign decree in India.
Documents To Keep Ready
- Passport, visa or residence permit and a copy of your Social Security or state ID of both spouses
- Marriage certificate and wedding photographs
- Address proofs in India and in the USA
- Messages, emails and call records relevant to the dispute
- Income, bank and tax records if maintenance is an issue
- Birth certificates and school records of any children
Points To Keep In Mind
- Do not sign settlement papers or consent documents without legal advice, even if they look routine.
- Check your visa status carefully. A divorce or separation can affect an H-4 or other dependent visa, so take advice from a US immigration attorney alongside ours.
- Tell us if there are children, because school, passport and custody questions need early planning.
- If you are being threatened with a criminal case or a lookout circular, tell us at once so we can plan travel safely.
- Plan consultation times around your US time zone, whether you are on the East Coast, in Texas or in California.

Typical Timeline For An NRI Case From the USA
- Week 1: consultation by phone or video at a time that suits you, and a review of your documents.
- Weeks 2 to 4: drafting of the petition or reply, and preparation of the power of attorney.
- Weeks 4 to 8: original documents reach us and the case is filed, or the reply is submitted in the Indian court.
- Months 2 to 6: hearings and, in contested cases, evidence. A mutual consent case can be much shorter when the court waives the cooling-off period.
- Final stage: the decree is passed and we obtain certified copies you can use in the USA.
Visa, Custody And Cross-Border Considerations
Families in the United States often face questions that go beyond the divorce itself: whether a spouse can remain in the country on a dependent visa, which court should decide custody, and whether a child can travel to India. India has not joined the Hague Convention on child abduction, so custody and travel questions need careful handling. We coordinate with your US counsel so that your Indian strategy and your US filings point in the same direction.
Illustrative Situations
General examples only. Every case depends on its own facts.
A spouse on an H-4 visa is asked to sign papers. A client was handed settlement papers by her husband in New Jersey. We reviewed them, pointed out that maintenance and custody terms were missing and helped her negotiate before signing.
A US citizen abroad is served with an Indian petition. The husband received a notice from a Delhi court. We appeared for him through a power of attorney, filed a reply and arranged video appearance for the one hearing that needed him.
A parent worries about a child being taken to India. The court was asked for interim directions on custody and travel, with the parent giving the necessary undertakings.

Frequently Asked Questions
Your Questions Answered
Straight answers to what clients ask us most often.
Ask Us DirectlyCan I get a mutual divorce in India while living in the USA?
Yes. Many NRIs complete a mutual divorce in India through a power of attorney and video appearance, subject to the court’s permission. Where the court waives the six-month cooling-off period on a waiver application, the case can often be finished in about 30 days.
Will an Indian divorce be valid in the USA?
An Indian decree is generally respected by US courts under the rules of comity, but each state applies its own tests and the rules may differ. We advise on the Indian side, and recommend that you confirm the US requirements with local counsel.
What if my spouse has filed a case in the USA?
A parallel case does not automatically stop your Indian case. The important questions are which court has jurisdiction and which decree can be enforced. We assess the position and plan a response, often with your US attorney, before you file or reply.
Do I need to be in Delhi for the hearings?
Not always. Where the court permits, you can appear by video link from the USA, and your advocate appears for you under a power of attorney. Some stages, such as recording statements in a mutual consent case, may need you to appear once, and we plan this around your visa and work.
How do I get a power of attorney ready in the USA?
Sign the power of attorney before a notary public in the US. It is then attested by the Indian Embassy or a Consulate, or apostilled where applicable, so please check the current requirement with us before you sign. We send you the draft and explain each step.
Is a US divorce decree valid in India?
Only if it passes the tests of Indian law, such as proper jurisdiction and a decision on the merits. A decree from the US can also be given effect by executing the foreign decree in India through the competent court, after it is recognised, but the court will examine it first. We advise before you rely on it.
Can a domestic violence case be filed in India against an NRI husband or his family?
Yes. Under the Protection of Women from Domestic Violence Act, 2005, a woman can ask an Indian court for protection, residence and monetary relief where she lives or has lived in a shared household, even if the husband now lives abroad. If you are the respondent, you can reply through an advocate and a power of attorney, so please contact us early.
Can I be arrested at the airport because of an Indian case?
A lookout circular or arrest warrant is possible in some criminal matters, such as 498A complaints, but it is not automatic. Early advice on anticipatory bail, quashing and travel planning matters, so contact us before you fly to India if a complaint has been filed.
Is my case kept confidential?
Yes. All consultations and documents are kept strictly confidential, and we only share them with the court and the people who need them for your case.
Can my children stay with me in the USA during the case?
This depends on the child’s residence, the orders of the court and the facts of the case. Moving a child between countries without the other parent’s consent can create serious legal problems, so please take advice before any travel.
