If you are in immediate danger, call the police on 112 or the Women Helpline on 181. Then reach out to someone you trust. If you want legal help, we can speak with you in confidence, and nothing you tell us is shared without your consent.
Domestic violence is not only hitting. It can be constant insults, controlling your money, threatening to throw you out, cutting you off from family, forcing you to bring dowry or making you feel worthless. Many women stay silent because they worry about the children, the family’s reputation or having nowhere to go. The law recognises these fears, and it gives you ways to stay safe without having to leave your home first.
What Counts As Domestic Violence?
The Protection of Women from Domestic Violence Act, 2005 covers abuse by a husband, partner in a live-in relationship or relatives in a domestic relationship. It recognises four forms:
- Physical abuse: hitting, pushing, burning or any act causing bodily harm or danger.
- Emotional and verbal abuse: humiliation, insults, accusing you of character, denying you a child or threatening to harm those you love.
- Sexual abuse: forced sexual acts or degrading conduct.
- Economic abuse: denying money, stridhan or household expenses, taking your salary, or stopping you from working.
What Relief Can The Court Give You?
Protection Order
Stops the abuser from committing violence, contacting you, entering your workplace or harassing your children.
Right To Residence
You cannot be thrown out of the shared household. The court can order the abuser to remove himself, or arrange alternate accommodation. In Satish Chander Ahuja v. Sneha Ahuja (2020) the Supreme Court gave a wider reading of “shared household”.
Monetary Relief
Compensation for lost earnings, medical expenses, loss of property and maintenance for you and your children.
Custody And Compensation
Temporary custody of children can be granted, and the court can award compensation for mental torture and emotional distress.
How To File A Domestic Violence Case
- Speak to us in confidence. We listen, assess your safety and explain your options.
- Collect what you can safely keep. Messages, photographs, medical records, police complaints and financial details all help.
- Approach a Protection Officer or file directly. An application under Section 12 is made before the Magistrate. You do not need to file a police case first.
- Seek urgent protection. We request interim protection, residence and maintenance orders from the first hearing.
- Parallel remedies. Where appropriate, we also advise on criminal complaints for cruelty, divorce petitions and custody applications.
If You Have Been Falsely Accused
False or exaggerated allegations also happen, and they can ruin families and reputations. We defend husbands and relatives against domestic violence applications by examining the complaint for inconsistencies, challenging overbroad allegations against distant relatives, and presenting your side with documents. We handle both sides of the matter with fairness and care.
Your Privacy Matters
Hearings in such cases can be held with sensitivity to the woman’s privacy, and we take care to keep your address, children’s details and personal information protected throughout.

Documents And Evidence That Help
- Photographs of injuries, damaged property or threatening messages
- Medical reports, hospital records and prescriptions
- Copies of police complaints, helpline records and counselling reports
- Bank statements and records that show control over money
- Messages, voice notes and emails, saved safely with dates
- Names of relatives, neighbours or colleagues who saw the abuse or its effects
- Marriage proof, address proof of the shared household and details of children
What Happens After You File
- Application. An application under Section 12 is made before the Magistrate, either by the woman, a Protection Officer or someone acting on her behalf.
- Domestic Incident Report. The Protection Officer may prepare a report and help you access medical aid, shelter homes and counselling.
- First hearing. The Magistrate fixes the first date, normally within three days, and issues notice to the respondent.
- Interim orders. If there is urgency, the court can pass protection, residence or monetary orders on an interim, and even ex parte, basis under Section 23.
- Reply and evidence. The respondent files a reply, and both sides can lead evidence.
- Final order. The court passes the final orders and can modify them later if circumstances change.
How Long Do The Orders Last, And What If They Are Breached?
A protection order remains in force until the aggrieved woman applies for it to be discharged. Breach of a protection order is itself an offence under Section 31 of the Act and can lead to imprisonment and fine. An appeal against an order lies to the Sessions Court within thirty days. Because enforcement can be a practical difficulty, we advise clients to keep a written record of every breach, with dates and evidence.
Illustrative Situations
General examples, not real clients.
A woman threatened with eviction. Her husband’s family tells her to leave the flat after a quarrel. She applies for a residence order, and the court restrains eviction while the case continues.
A woman denied household money. The husband controls all accounts and gives no money for food or medicines. She seeks monetary relief and maintenance for herself and the children.
A husband served with a notice. He believes the allegations are exaggerated. He files a detailed reply with documents and appears at every hearing, which is the safest way to protect himself.
If You Are The Respondent
Being named in a domestic violence application is distressing, but it is not a finding of guilt. You should read the application carefully, collect relevant documents, avoid contacting the applicant in a threatening manner and attend every hearing. We prepare a factual reply and challenge claims against relatives who had no real role in the household, while respecting the court’s concern for the safety of the applicant.
Interim Maintenance And Compensation
You do not have to wait for the final order to receive financial support. The Magistrate can order interim maintenance while the case is pending and can later award compensation for injuries, including mental torture and emotional distress. Read the full guide on interim maintenance and compensation in domestic violence cases.
Contested Divorce And Domestic Violence
Where the marriage cannot continue and your spouse will not agree, a contested divorce can be filed alongside, or after, the domestic violence case. Cruelty is a ground for divorce under Section 13(1)(ia) of the Hindu Marriage Act, and the evidence in the protection case, such as medical records, messages and police complaints, often supports it.
- Interim maintenance under Section 24 of the Hindu Marriage Act while the divorce is pending.
- Permanent alimony under Section 25 when the decree is passed.
- Custody and visitation of the children, decided on their welfare.
- Both cases together. The two proceedings run in different courts, so dates and evidence must be coordinated.
Mutual Consent Divorce Where There Has Been Domestic Violence
Some couples reach a point where both want a quick, settled end. A mutual consent divorce under Section 13B is possible only if the consent is free and not given under pressure or fear. The settlement should record maintenance, stridhan, custody and the treatment of pending cases, including any domestic violence or 498A case, which can be closed only with the court’s permission.
- About 30 days. Where the court waives the six-month cooling-off period on a waiver application, a mutual consent divorce can be completed in about 30 days.
- Before one year of marriage. In special cases, a divorce can be filed before one year of marriage, with special circumstances such as cruelty, adultery or bigamy, by using Section 14 of the Hindu Marriage Act. The court decides whether to give leave.
- Written terms. Everything agreed should be written in the settlement and made part of the decree.

No. You can file while still living in the shared household, and the court can protect your right to stay there.
Is a police complaint necessary first?
No. An application under Section 12 of the Domestic Violence Act can be made directly to the Magistrate, with or without a police complaint.
Can a live-in partner file a case?
Yes. The Act covers women in relationships in the nature of marriage, which includes certain live-in relationships.
What can I claim apart from protection?
You can seek a right to residence, monthly maintenance, compensation, custody of children and return of stridhan and personal belongings.
Can a husband or his family file a case against abuse?
The 2005 Act protects women. Men facing abuse can use other legal remedies, such as criminal complaints and civil relief, and we can advise on those.
How do I prove domestic violence?
Medical reports, photographs, messages, police records, witness statements and your own consistent testimony are all useful. Courts also consider the overall pattern.
What if I have been accused falsely?
You should not ignore the notice. We examine the allegations, prepare a reply and defend you at every hearing.
What is a Protection Officer?
A Protection Officer is an official appointed under the Act to help women file applications, prepare reports, get medical help and shelter, and assist in enforcement of orders.
Can a case be filed years after the abuse?
There is flexibility for continuing acts of violence and for claims connected with ongoing rights such as residence and maintenance, but delay can raise questions. It is better to seek advice as soon as you can.
Are relatives of the husband also liable?
The respondent can include relatives, but courts expect specific allegations. Omnibus accusations against distant relatives may be challenged.
Can the case be settled?
Yes, with the permission of the court. Settlement terms should be recorded in writing and made part of the order.
Can I get interim maintenance while my domestic violence case is pending?
Yes. The Magistrate can pass interim orders, including monthly maintenance for you and your children, under Section 23 of the Domestic Violence Act. See our page on interim maintenance and compensation.
Can a mutual consent divorce be completed in 30 days?
In suitable cases, yes. Once the court waives the six-month cooling-off period on a waiver application, the process can be completed in about 30 days. Waiver is the court’s decision and depends on the facts.
Can I file for divorce before one year of marriage if there has been domestic violence?
In special cases, a divorce can be filed before one year of marriage, with special circumstances, by using Section 14 of the Hindu Marriage Act, for example in cases of cruelty, adultery or bigamy. The court decides whether to give leave, and the facts must be set out clearly in the application.
