Working In Germany, With A Marriage Case Back In India

Germany has a fast-growing Indian community, with many people working in engineering, IT and research on Blue Card or work permits, and others studying. Marriages are often arranged in India, and spouses may live in different countries for long periods.

When a marriage breaks down, the first question is where to proceed. We explain how an Indian case works, what a German family court may decide and what could go wrong if two cases run together without a plan.

The Legal Position For Indians In Germany

German divorce law usually looks to a period of separation before a divorce is granted, and German family courts require lawyer representation in divorce cases. A marriage registered in India stays governed by Indian law for its validity, so an Indian case can continue even while a German case is under way.

Germany is not a reciprocating territory for Section 44A of the Code of Civil Procedure, so a German decree is usually tested in India through a suit on the decree. We examine the order and explain what is needed before it is accepted for remarriage, property or inheritance.

How We Run Your Case From India

  1. 100% confidential consultation at a time that suits you. We speak by phone, WhatsApp or video, and plan around your time zone (Germany is 3.5 to 4.5 hours behind India).
  2. Fix the right forum. We study where you married, where you last lived together and where your spouse lives, to decide whether the Indian court, the court in Germany, or both are in play.
  3. Power of attorney and documents. You sign a power of attorney and have it signed before a German notary and apostilled where required, or attested at the Embassy of India in Berlin or a consulate. We tell you exactly which documents to sign and how to send them.
  4. Filing and hearings in India. We file and appear for you. Where the court permits, you join key hearings by video from Germany.
  5. Settlement or trial. If a settlement is possible, we draft it carefully. If not, we prepare the evidence and argue the case on its merits.
  6. Decree and recognition. We obtain certified copies and help you use the decree in Germany, with advice on recognition and, where needed, on executing a foreign decree in India.

Documents To Keep Ready

  • Passport, visa or residence permit and a copy of your Blue Card, residence permit or student visa and registration certificate (Anmeldung) of both spouses
  • Marriage certificate and wedding photographs
  • Address proofs in India and in Germany
  • Messages, emails and call records relevant to the dispute
  • Income, bank and tax records if maintenance is an issue
  • Birth certificates and school records of any children

Points To Keep In Mind

  • Do not sign settlement papers or consent documents without legal advice, even if they look routine.
  • Keep your residence permit and registration papers ready, since they are often asked for when documents are verified.
  • Tell us if there are children, because school, passport and custody questions need early planning.
  • If you are being threatened with a criminal case or a lookout circular, tell us at once so we can plan travel safely.
  • Schedule consultation times for Germany, which is 3.5 to 4.5 hours behind India, so mornings in India suit afternoons in Germany.
Foreign and Indian decrees are not always interchangeable. Indian courts recognise a foreign divorce decree only if it meets certain tests, such as proper jurisdiction and a decision on the merits under the law that governed the marriage (Y. Narasimha Rao v. Venkata Lakshmi, 1991). Always get advice before relying on a divorce obtained abroad.

Typical Timeline For An NRI Case From Germany

  1. Week 1: consultation by phone or video at a time that suits you, and a review of your documents.
  2. Weeks 2 to 4: drafting of the petition or reply, and preparation of the power of attorney.
  3. Weeks 4 to 8: original documents reach us and the case is filed, or the reply is submitted in the Indian court.
  4. Months 2 to 6: hearings and, in contested cases, evidence. A mutual consent case can be much shorter when the court waives the cooling-off period.
  5. Final stage: the decree is passed and we obtain certified copies you can use in Germany.

Berlin, Munich And Work Permit Questions

Many Indian clients in Germany are worried about their residence status, which may depend on a job or a spouse. We advise on the Indian court process and work alongside your German lawyer and an immigration adviser so that you do not lose time or rights. We also keep your matter confidential, because many clients are concerned about their workplace or community.

Illustrative Situations

General examples only. Every case depends on its own facts.

A spouse in Munich is unsure where to file. She had married in Delhi and moved to Germany. We explained her options in India, including maintenance and custody, before she took any step in Germany.

A husband in Berlin receives a court notice. He had not understood the notice from India. We replied on time through a power of attorney and arranged video appearance.

A couple agrees to separate quietly. They agreed on a settlement, and we filed a mutual consent petition in Delhi, seeking a waiver of the cooling-off period.

Frequently Asked Questions

Your Questions Answered

Straight answers to what clients ask us most often.

Ask Us Directly
Can I get a mutual divorce in India while living in Germany?

Yes. Many NRIs complete a mutual divorce in India through a power of attorney and video appearance, subject to the court’s permission. Where the court waives the six-month cooling-off period on a waiver application, the case can often be finished in about 30 days.

Will an Indian divorce be valid in Germany?

An Indian decree is considered in Germany under its own recognition rules. We advise on the Indian side and recommend confirming the German position with a local lawyer.

What if my spouse has filed a case in Germany?

A German case does not automatically stop your Indian case. The question is which court has proper jurisdiction and which order can be enforced. We assess the position and plan a response before you reply or file.

Do I need to be in Delhi for the hearings?

Not always. Where the court permits, you can appear by video link from Germany, and your advocate appears for you under a power of attorney. Some stages, such as recording statements in a mutual consent case, may need you to appear once, and we plan this around your visa and work.

How do I get a power of attorney ready in Germany?

Sign the power of attorney before a notary in Germany. It is then apostilled where required, or attested by the Embassy of India in Berlin or a consulate. We confirm the route before you sign.

Is a German divorce decree valid in India?

Only if it passes the tests of Indian law. Germany is not a reciprocating territory, so a German decree is normally tested in India through a suit on the decree, after which it can be given effect by executing the foreign decree in India. The court examines it first.

Can a domestic violence case be filed in India against an NRI husband or his family?

Yes. Under the Protection of Women from Domestic Violence Act, 2005, a woman can ask an Indian court for protection, residence and monetary relief where she lives or has lived in a shared household, even if the husband now lives abroad. If you are the respondent, you can reply through an advocate and a power of attorney, so please contact us early.

Can I be arrested at the airport because of an Indian case?

A lookout circular or arrest warrant is possible in some criminal matters, such as 498A complaints, but it is not automatic. Early advice on anticipatory bail, quashing and travel planning matters, so contact us before you fly to India if a complaint has been filed.

Is my case kept confidential?

Yes. All consultations and documents are kept strictly confidential, and we only share them with the court and the people who need them for your case.

Can my children stay with me in Germany during the case?

This depends on the child’s residence, the orders of the court and the facts. Moving a child between countries without agreement can lead to legal problems, so please take advice first.
