Far From Home, A Marriage Dispute Can Feel Even Heavier

Many Indian families in the UAE are one job loss or one argument away from not knowing where to turn. You may be worried about your residence visa, your children’s school, or what happens if your spouse files a case in India while you are in Dubai. Perhaps you are the spouse in India who has been left behind. In both situations, delay usually makes things worse.

The first thing we do is calm the situation: we explain what the Indian court can and cannot do, what you should avoid saying or signing, and how to plan your next steps without risking your stay in the UAE.

The Legal Position For Indians In the UAE

Indian Hindus, Sikhs, Jains and Buddhists who married in India under the Hindu Marriage Act remain governed by it even while living in the UAE, so an Indian court generally has jurisdiction over their marriage. At the same time, the UAE has civil family courts in some emirates that deal with divorce for non-Muslim foreigners. Having two proceedings in two countries can create conflict, which is why advice on strategy is essential before filing anywhere.

If your spouse files in the UAE while you are in India, or the reverse, the question is which decree will be recognised where. We examine the facts and the law of both countries with you before recommending a path.

How We Run Your Case From India

  1. 100% confidential consultation at a time that suits you. We speak by phone, WhatsApp or video, and plan around your time zone and working hours in the UAE.
  2. Fix the right forum. We study where you married, where you last lived together and where each spouse lives, and decide whether to file in India, defend in India or work in both places.
  3. Power of attorney and documents. You sign a power of attorney and have it attested by the Indian Embassy or consulate, or apostilled where applicable, then courier it to us.
  4. Filing and hearings in India. We file and appear for you. Where the court permits, you join the hearing by video conference.
  5. Settlement or trial. If a settlement is possible, we draft it carefully. If not, we prepare evidence by affidavit and prepare you for any virtual cross-examination.
  6. Decree and recognition. We obtain certified copies and help you use the decree in the UAE where needed for remarriage, immigration or property matters.

Documents To Keep Ready

  • Passport, visa or residence permit and local ID copies of both spouses
  • Marriage certificate and wedding photographs
  • Address proofs in India and in the UAE
  • Messages, emails and call records relevant to the dispute
  • Income, bank and tax records if maintenance is an issue
  • Birth certificates and school records of any children

Points To Keep In Mind

  • Do not sign settlement papers or consent documents in the UAE without Indian legal advice.
  • Keep your residence visa and Emirates ID details handy for your power of attorney.
  • Tell us if there are children, because school and travel decisions affect custody.
  • If you are being threatened with a criminal case in India, contact us at once to discuss anticipatory bail.
  • Choose consultation times that suit the UAE evening, as we are available on WhatsApp and video.
Foreign and Indian decrees are not always interchangeable. Indian courts recognise a foreign divorce decree only if it meets certain tests, such as proper jurisdiction and a decision on the merits under the law that governed the marriage (Y. Narasimha Rao v. Venkata Lakshmi, 1991). Always get advice before relying on a divorce obtained abroad.

Typical Timeline For An NRI Case From the UAE

  1. Week 1: consultation by phone or video at a time that suits your Gulf working-week schedule, and a review of documents sent by email or WhatsApp.
  2. Weeks 2 to 4: drafting of the petition or reply, and preparation of the power of attorney for attestation or apostille as applicable in the UAE.
  3. Weeks 4 to 8: original documents reach us by courier, and the case is filed or the reply is submitted.
  4. Months 2 to 8: hearings in India. We report after every date, and you join by video only when the court requires it.
  5. Final stage: the decree is passed, and we obtain certified copies and advise on their use in the UAE.

Dubai, Abu Dhabi And Sharjah Considerations

Families in the UAE often live in a different emirate from where their jobs are, and they move frequently. Please keep a record of every address and residency change, since the other side’s notice must reach you at a valid address. Weekend consultations are available for clients who work long weekday hours. If a local court has already passed an order concerning your marriage or children, share it with us at once, because it may affect what an Indian court can do.

Illustrative Situations

General examples, not real clients.

A spouse far from the courtroom. A client based in the UAE gets a notice and cannot travel. We reply on time, apply for dates that suit the client and arrange a video appearance for the one hearing that requires it.

A settlement across borders. The spouses agree on terms on a video call. We record the terms in a written agreement, have it signed and attested abroad and present it to the Indian court.

A parent who wants to stay in touch with a child. The court orders video calls at fixed times, and we help the parent set a routine that works across time zones.

Mutual consent divorce in about 30 days. Under Indian divorce law, where the court waives the six-month cooling-off period, a mutual consent divorce can be completed in about 30 days. In special cases, a divorce can be filed before one year of marriage, with special circumstances, by using Section 14 of the Hindu Marriage Act. Read more about mutual consent divorce.

Your Questions Answered

Yes. Many Dubai residents complete a mutual divorce in India using a power of attorney and video appearance, subject to the court’s permission.

Will an Indian divorce be valid in the UAE?

Generally an Indian decree is used for documentation in many matters, but acceptance depends on the authority. We advise on how to use it.

What if my spouse has filed a case in the UAE?

We review the papers, check jurisdiction and decide whether to defend in the UAE, in India or both.

Do I need to be in Delhi for the hearings?

Not always. Where the court permits, you can appear by video conference from the UAE.

How do I attest a power of attorney in the UAE?

We give you a draft and tell you the steps for attestation by the Indian Embassy or consulate or apostille where applicable.

Is my case kept confidential?

Yes. Everything you share with us remains confidential.

Is a UAE court order on custody valid in India?

Not automatically. Indian courts decide on the welfare of the child and examine any foreign order, so we advise before you rely on it.

Can I be arrested at the airport because of an Indian case?

A warrant or lookout circular is possible only in specific situations. If you have received a criminal notice, call us before you travel.

Can my children stay with me in the UAE during the case?

It depends on existing orders and the other parent’s consent. We advise on safe arrangements.

What if my spouse is in the UAE and I am in India?

We file or defend in India and handle service of notice abroad lawfully.

Can a domestic violence case be filed in India against an NRI husband or his family?

Yes. Under the Protection of Women from Domestic Violence Act, 2005, a woman can ask an Indian court for protection, residence and monetary relief where she lives or has lived in a shared household, even if the husband now lives abroad. If you are the respondent, you can reply through an advocate and a power of attorney, so please contact us early.
