Two Countries, Two Laws, One Marriage

You may have moved to Australia on a skilled visa, studied there or followed a spouse. Years later, the marriage is in trouble, and you discover that a case could be filed in Australia, in India or in both. Friends tell you contradictory things. A court notice from Delhi arrives while you are at work in Sydney. You are not sure whether an Australian divorce will be accepted in India or whether you still need an Indian decree.

These are the problems we solve every week for clients in Australia. Our first step is to give you a clear, written plan so you stop guessing.

The Legal Position For Indians In Australia

In Australia, divorce falls under the Family Law Act 1975 and is based on a single ground, that the marriage has broken down irretrievably, shown by twelve months of separation. An application is made to the Federal Circuit and Family Court of Australia, generally when either spouse is an Australian citizen, is domiciled in Australia or has lived there for the preceding year. Property and parenting matters are decided separately.

In India, a marriage under the Hindu Marriage Act ends only on the grounds in that Act, or by mutual consent. Indian courts recognise a foreign decree only if it passes the tests in Y. Narasimha Rao v. Venkata Lakshmi, and an Australian no-fault decree may not be accepted if the other spouse did not submit to that court. That is why many couples do both: an Australian decree for life in Australia, and an Indian decree to remove doubt in India.

How We Run Your Case From India

  1. 100% confidential consultation at a time that suits you. We speak by phone, WhatsApp or video, and plan around your time zone and working hours in Australia.
  2. Fix the right forum. We study where you married, where you last lived together and where each spouse lives, and decide whether to file in India, defend in India or work in both places.
  3. Power of attorney and documents. You sign a power of attorney and have it attested by the Indian Embassy or consulate, or apostilled where applicable, then courier it to us.
  4. Filing and hearings in India. We file and appear for you. Where the court permits, you join the hearing by video conference.
  5. Settlement or trial. If a settlement is possible, we draft it carefully. If not, we prepare evidence by affidavit and prepare you for any virtual cross-examination.
  6. Decree and recognition. We obtain certified copies and help you use the decree in Australia where needed for remarriage, immigration or property matters.

Documents To Keep Ready

  • Passport, visa or residence permit and local ID copies of both spouses
  • Marriage certificate and wedding photographs
  • Address proofs in India and in Australia
  • Messages, emails and call records relevant to the dispute
  • Income, bank and tax records if maintenance is an issue
  • Birth certificates and school records of any children

Points To Keep In Mind

  • Tell us before you file in Australia, so that we can plan the Indian side at the same time.
  • Keep your visa status in mind, since relationship breakdown can affect partner visas, and take Australian immigration advice where needed.
  • Property and parenting arrangements in Australia are decided there, but maintenance and stridhan can be claimed in India.
  • Our Sydney contact address is 13 Meacher Street, Mount Druitt, NSW 2770, and we also offer evening video calls in Australian time.
  • Time difference with India is between 4.5 and 5.5 hours, depending on daylight saving.
Foreign and Indian decrees are not always interchangeable. Indian courts recognise a foreign divorce decree only if it meets certain tests, such as proper jurisdiction and a decision on the merits under the law that governed the marriage (Y. Narasimha Rao v. Venkata Lakshmi, 1991). Always get advice before relying on a divorce obtained abroad.

Typical Timeline For An NRI Case From Australia

  1. Week 1: consultation by phone or video at a time that suits your Sydney or Melbourne schedule, and a review of documents sent by email or WhatsApp.
  2. Weeks 2 to 4: drafting of the petition or reply, and preparation of the power of attorney for attestation or apostille as applicable in Australia.
  3. Weeks 4 to 8: original documents reach us by courier, and the case is filed or the reply is submitted.
  4. Months 2 to 8: hearings in India. We report after every date, and you join by video only when the court requires it.
  5. Final stage: the decree is passed, and we obtain certified copies and advise on their use in Australia.

Australia: Parallel Proceedings And Property

Couples in Australia often have property, superannuation and children in Australia, along with a marriage registered in India. The Australian court decides property and parenting matters under its own law, while Indian courts decide the validity of the marriage under Indian law, and may also decide maintenance and stridhan. The best results come when advisers in both countries coordinate. We can work with your Australian family lawyer, share Indian court papers promptly and ensure that the settlement and decrees fit together.

Illustrative Situations

General examples, not real clients.

A spouse far from the courtroom. A client based in Australia gets a notice and cannot travel. We reply on time, apply for dates that suit the client and arrange a video appearance for the one hearing that requires it.

A settlement across borders. The spouses agree on terms on a video call. We record the terms in a written agreement, have it signed and attested abroad and present it to the Indian court.

A parent who wants to stay in touch with a child. The court orders video calls at fixed times, and we help the parent set a routine that works across time zones.

Mutual consent divorce in about 30 days. Under Indian divorce law, where the court waives the six-month cooling-off period, a mutual consent divorce can be completed in about 30 days. In special cases, a divorce can be filed before one year of marriage, with special circumstances, by using Section 14 of the Hindu Marriage Act. Read more about mutual consent divorce.

Will an Australian divorce be valid in India?

Not always automatically. It depends on whether it meets Indian legal tests, including the other spouse’s participation.

Can I defend a case in Delhi from Sydney or Melbourne?

Yes, through a power of attorney, and video appearance where the court permits.

Does my marriage in India affect my Australian visa?

Separation can affect some visa types, so also take advice from a registered Australian migration agent.

How long does an Indian divorce take if I live in Australia?

A mutual consent divorce can be completed in months. A contested case takes longer.

Often yes, as foreign decrees can be recognised under Australian law subject to the Act’s requirements. Your Australian lawyer will advise.

It is dealt with under Australian law. Indian courts may consider assets when deciding maintenance.
