Far Across The Pacific, Still Tied To A Case In India

New Zealand attracts Indian professionals, students and families, many of whom arrived with spouses and plans for a new start. When the relationship fails, you may find yourself far from relatives, juggling work, visas and childcare, while your spouse or in-laws in India begin legal action. The time difference makes everything harder.

Our job is to carry the Indian side of your case so you can focus on staying stable in New Zealand.

The Legal Position For Indians In New Zealand

In New Zealand, the Family Court can dissolve a marriage if it has broken down irreconcilably, which is established by the spouses having lived apart for at least two years, and usually where at least one spouse is domiciled in New Zealand. Parenting and property matters are decided under separate laws.

A New Zealand dissolution may not automatically satisfy Indian law. Indian courts examine whether the foreign court had proper jurisdiction and whether the decision is on a ground available under the law governing the marriage, unless the other spouse has genuinely submitted to the foreign court. Because of this, many couples obtain an Indian decree as well, especially where there is property or a plan to remarry.

How We Run Your Case From India

  1. 100% confidential consultation at a time that suits you. We speak by phone, WhatsApp or video, and plan around your time zone and working hours in New Zealand.
  2. Fix the right forum. We study where you married, where you last lived together and where each spouse lives, and decide whether to file in India, defend in India or work in both places.
  3. Power of attorney and documents. You sign a power of attorney and have it attested by the Indian Embassy or consulate, or apostilled where applicable, then courier it to us.
  4. Filing and hearings in India. We file and appear for you. Where the court permits, you join the hearing by video conference.
  5. Settlement or trial. If a settlement is possible, we draft it carefully. If not, we prepare evidence by affidavit and prepare you for any virtual cross-examination.
  6. Decree and recognition. We obtain certified copies and help you use the decree in New Zealand where needed for remarriage, immigration or property matters.

Documents To Keep Ready

  • Passport, visa or residence permit and local ID copies of both spouses
  • Marriage certificate and wedding photographs
  • Address proofs in India and in New Zealand
  • Messages, emails and call records relevant to the dispute
  • Income, bank and tax records if maintenance is an issue
  • Birth certificates and school records of any children

Points To Keep In Mind

  • Share your Indian marriage certificate, passport and immigration status with us early.
  • Do not ignore Indian notices. Courts can proceed ex parte if you do not respond.
  • If you need to settle quickly, ask us about mutual consent with waiver of the six-month period.
  • Children living in New Zealand raise custody questions in both countries, so plan with advice.
  • New Zealand is 6.5 to 7.5 hours ahead of India, so we schedule consultations at times convenient to you.
Foreign and Indian decrees are not always interchangeable. Indian courts recognise a foreign divorce decree only if it meets certain tests, such as proper jurisdiction and a decision on the merits under the law that governed the marriage (Y. Narasimha Rao v. Venkata Lakshmi, 1991). Always get advice before relying on a divorce obtained abroad.

Typical Timeline For An NRI Case From New Zealand

  1. Week 1: consultation by phone or video at a time that suits your Auckland or Wellington schedule, and a review of documents sent by email or WhatsApp.
  2. Weeks 2 to 4: drafting of the petition or reply, and preparation of the power of attorney for attestation or apostille as applicable in New Zealand.
  3. Weeks 4 to 8: original documents reach us by courier, and the case is filed or the reply is submitted.
  4. Months 2 to 8: hearings in India. We report after every date, and you join by video only when the court requires it.
  5. Final stage: the decree is passed, and we obtain certified copies and advise on their use in New Zealand.

New Zealand: Separation, Property And Children

New Zealand law treats separation, property and children as separate questions. A dissolution of marriage can be applied for after two years of living apart, but property division and parenting arrangements are dealt with under other legislation. If your marriage is registered in India, you should plan how the Indian and New Zealand outcomes will fit. We work with you and your local lawyer so that, for example, an Indian settlement does not contradict a New Zealand property order.

Illustrative Situations

General examples, not real clients.

A spouse far from the courtroom. A client based in New Zealand gets a notice and cannot travel. We reply on time, apply for dates that suit the client and arrange a video appearance for the one hearing that requires it.

A settlement across borders. The spouses agree on terms on a video call. We record the terms in a written agreement, have it signed and attested abroad and present it to the Indian court.

A parent who wants to stay in touch with a child. The court orders video calls at fixed times, and we help the parent set a routine that works across time zones.

Please note: This page gives general information and is not legal advice. Every case depends on its own facts, so please consult an advocate before acting.
Mutual consent divorce in about 30 days. Under Indian divorce law, where the court waives the six-month cooling-off period, a mutual consent divorce can be completed in about 30 days. In special cases, a divorce can be filed before one year of marriage, with special circumstances, by using Section 14 of the Hindu Marriage Act. Read more about mutual consent divorce.

Frequently Asked Questions

Your Questions Answered

Straight answers to what clients ask us most often.

Ask Us Directly
Can I get divorced in New Zealand and in India?

Yes, and many people do both so that their status is clear in each country.

Is a New Zealand divorce accepted in India?

Not automatically. Indian courts apply specific tests, so we advise before you rely on it.

Can my in-laws file a case against me in India while I am in NZ?

They can file proceedings, but you can respond through a power of attorney and an Indian advocate.

Do I have to fly to India for a mutual consent divorce?

Often not. Video appearance and waiver of waiting periods can reduce or remove the need to travel.

What about my children?

Custody depends on where the children live and the welfare principle. We advise on both countries.

How do I start?

Call or WhatsApp 95606 02012 for a 100% confidential consultation.

Is the two-year separation rule strict?

It is the usual evidence of irreconcilable breakdown, with limited exceptions, so plan accordingly.

Can my children travel to India during the case?

Typically with the other parent’s consent or a court order. We advise on safe arrangements.

Is video evidence accepted in Indian courts?

In many cases, subject to directions of the court and the stage of the case.

Does NZ recognise Indian divorce decrees?

Often yes, subject to its rules. Your NZ lawyer can confirm.

Can a domestic violence case be filed in India against an NRI husband or his family?

Yes. Under the Protection of Women from Domestic Violence Act, 2005, a woman can ask an Indian court for protection, residence and monetary relief where she lives or has lived in a shared household, even if the husband now lives abroad. If you are the respondent, you can reply through an advocate and a power of attorney, so please contact us early.
