Divorce Lawyer For Delhi Courts

Matrimonial disputes in the capital are decided by the family courts attached to the district court complexes, with appeals going to the Delhi High Court and, in the end, to the Supreme Court of India. The complex that has authority over your case is decided by the address of the parties and the place where the marriage was held or where you last lived together.

Divorce matters need an advocate who knows both the law and the daily working of the court. Advocate Manish Kumar of S.S Associates practises from Chamber No. 551-B at the Dwarka Courts and appears before the Delhi courts, advising clients in Hindi and English and keeping every consultation confidential.

The Legal Framework

Divorce in India is governed by the personal law of the parties. Hindus, Buddhists, Jains and Sikhs are covered by the Hindu Marriage Act, 1955, interfaith couples and civil marriages by the Special Marriage Act, 1954, and other communities by their own statutes. The choice of law and of the right court shapes every other decision, so it is the first thing we settle.

There are two broad routes. In a mutual consent divorce, both spouses agree and apply jointly under Section 13B, which is faster and less costly. In a contested divorce, one spouse files on a ground such as cruelty or desertion under Section 13 and must prove it in court. A third option, judicial separation under Section 10, is available when the spouses are not ready to end the marriage.

The decision about which route to take is not only legal. It involves money, children, property, family reputation and your own wellbeing. We discuss all of these, explain the likely outcomes without false promises and then act on the path you choose.

How A Divorce Case Proceeds

  1. Confidential consultation in which we listen to your story and review the documents you have.
  2. Advice on the right route, such as mutual consent, contested divorce or separation.
  3. Drafting and filing of the petition in the court that has jurisdiction.
  4. Handling of interim matters such as maintenance, custody and residence.
  5. Mediation and settlement attempts, which courts usually require.
  6. Evidence and arguments, if the case is contested, followed by judgment.

Documents We Ask You To Prepare

  • Marriage certificate and wedding photos
  • Identity and address proofs of both spouses
  • Income and asset records
  • Details of children
  • Evidence of the grounds you rely on
  • Any earlier notices, complaints or orders

Timeline And What Affects It

A mutual consent divorce can be finished in a few months, and sometimes sooner. A contested divorce commonly runs from two to five years. Your advocate’s preparation and the other side’s conduct both affect the speed.

Practising Before Delhi Courts

Delhi family courts follow the Family Courts Act, 1984, which requires the court to try for reconciliation and to refer suitable cases to mediation before a full trial. Hearings are listed through the court cause list each morning, so your advocate has to be present and prepared at short notice.

Practical tip. Courts in Delhi are busy. Cases move faster when documents are organised, addresses for service are correct and the petition states each ground clearly.

Illustrative Situations

These are general illustrations of the kinds of problems we are asked about. They are not real client cases and every matter turns on its own facts.

  • Spouses living in separate neighbourhoods: The husband lives in South Delhi and the wife in North Delhi. We identify the court with territorial jurisdiction and the one most practical for both parties.
  • A long-pending case needing direction: A matrimonial petition has been listed for years with no progress. We study the order sheet to see what is holding it up and which application can restart it.
  • An urgent interim need: A wife with a young child has no income and needs maintenance quickly. We file an interim application with her income and expense affidavit.
Please note. This page gives general information and is not a substitute for advice on your own facts. Laws and court procedures change, so please speak to an advocate before you act.

Frequently Asked Questions

Your Questions Answered

Straight answers to what clients ask us most often.

Ask Us Directly
How do I start a divorce case?

Begin with a consultation, gather your marriage and identity documents, decide whether to proceed by mutual consent or contest, and have a petition drafted and filed in the right court.

Which is better, mutual or contested divorce?

Mutual consent is faster and cheaper but needs agreement on all terms. A contested divorce is for cases where the other side will not agree.

How long does divorce take in Delhi?

From a month or two for a well-prepared mutual petition to several years for a contested case.

Will I get custody of my child?

Custody depends on the child’s welfare. Neither parent has an automatic right, and courts consider the child’s circumstances and wishes.

Can I speak to the lawyer directly?

Yes. You will speak directly with Advocate Manish Kumar, in Hindi or English.

Which court will hear my divorce case if I live near the Delhi courts?

The complex that has authority over your case is decided by the address of the parties and the place where the marriage was held or where you last lived together.

Do you appear before Delhi Courts?

Yes. Advocate Manish Kumar appears before the Delhi courts and the other Delhi courts, with chambers at Dwarka Court, Sector 10, New Delhi 110075.
