Understanding The Headline
The headline above summarises a reported position or a legal question. Court decisions depend on the facts and the evidence placed before the judge, and a short summary cannot capture every detail. This page therefore explains the law that sits behind the topic instead of reproducing the order. To read the exact reasoning of any judgment, please refer to the judgment itself on the court’s official website or in the recognised law reports.
How The Law Treats Live-In Relationships
India has no separate statute for live-in relationships, yet courts have recognised them as a relationship that is not illegal. The Supreme Court has held that a long-term live-in relationship can be treated as a relationship in the nature of marriage for the purposes of certain protections.
The Domestic Violence Act, 2005 expressly protects women in a relationship in the nature of marriage. Courts have also granted protection from harassment to adult couples living together, and they have discussed the rights of children born from such relationships.
Rights And Limits
A live-in relationship is not a marriage, so a couple cannot ask for divorce, and succession and maintenance rights depend on the facts. A woman in a qualifying relationship can claim maintenance under the Domestic Violence Act and, in some cases, under Section 144 of the Bharatiya Nagarik Suraksha Sanhita.
Children born from such a relationship are legitimate in terms of Section 16 of the Hindu Marriage Act in certain situations and, according to the Supreme Court, can claim a share in the father’s property. Courts have decided each of these questions on its own facts.
Practical Advice
A written cohabitation agreement, proof of joint residence and clear records of finances help establish the nature of the relationship if a dispute arises. When one partner is already married, the legal analysis becomes more complex, and advice should be taken early.
