Married Abroad, Divorcing In India: Where Do You Even Begin?

Some couples marry at a beach in Bali, in a registry office in London, in a church in Canada or through a ceremony in India with a foreign spouse. Years later, when things fall apart, they discover that no one explained which country’s law governs the marriage, or which court can end it. Without the right answer, you risk starting a case in the wrong place, spending money twice or ending up with a decree that no authority accepts.

Which Law Applies To A Marriage Abroad?

  • Foreign Marriage Act, 1969: covers marriages solemnised before a Marriage Officer abroad where at least one party is an Indian citizen. Matters of divorce and nullity are dealt with under the provisions of the Special Marriage Act as applied by this Act.
  • Marriage under the foreign country’s law: a marriage validly performed abroad is generally treated as valid, but the Indian court will examine jurisdiction and applicable law before granting relief.
  • Marriage in India with a foreign national: may be under the Hindu Marriage Act, the Special Marriage Act or the personal law of the religion followed, depending on the ceremony and registration.

Typical Problems In Foreign Marriage Cases

  • Not knowing whether the marriage is registered in India, abroad or both
  • Spouse in another country refusing to cooperate or respond to notices
  • Difficulty serving court papers on a spouse who lives abroad
  • Children with dual nationality or living in a different country from one parent
  • Property, bank accounts and investments in more than one country
  • Questions about whether a foreign divorce already obtained is valid in India

How We Handle These Cases

  1. Identify the governing law. We review the marriage certificate, registration details and how and where the ceremony took place.
  2. Select the court. We decide whether an Indian court has jurisdiction and whether to file in India or advise on proceedings abroad.
  3. Serve the other spouse. We plan service of notice through lawful channels to avoid later objections.
  4. Protect your interests. We seek interim relief on maintenance and custody where required.
  5. Obtain and use the decree. We obtain certified copies and advise on recognition by foreign authorities.
Recognition is a two-way street. A foreign decree may need to satisfy Indian tests under Section 13 of the Code of Civil Procedure, and an Indian decree may need to be recognised abroad. Do not remarry or change records before confirming validity.

Typical Timeline For An NRI Case From abroad

  1. Week 1: consultation by phone or video at a time that suits your overseas schedule, and a review of documents sent by email or WhatsApp.
  2. Weeks 2 to 4: drafting of the petition or reply, and preparation of the power of attorney for attestation or apostille as applicable in abroad.
  3. Weeks 4 to 8: original documents reach us by courier, and the case is filed or the reply is submitted.
  4. Months 2 to 8: hearings in India. We report after every date, and you join by video only when the court requires it.
  5. Final stage: the decree is passed, and we obtain certified copies and advise on their use in abroad.

Mixed Nationality And Cross-Border Problems

Marriages between an Indian citizen and a foreign national, or marriages performed abroad, raise special problems. The law that governs the marriage may differ from the law of the country where you live. Children may have two nationalities, and each parent may want them to live in a different country. Property may be in India, abroad or both. We map each of these issues for you in writing and recommend a sequence: for example, whether to settle custody first, finalise divorce first or fix property first.

Illustrative Situations

General examples, not real clients.

A spouse far from the courtroom. A client based in another country gets a notice and cannot travel. We reply on time, apply for dates that suit the client and arrange a video appearance for the one hearing that requires it.

A settlement across borders. The spouses agree on terms on a video call. We record the terms in a written agreement, have it signed and attested abroad and present it to the Indian court.

A parent who wants to stay in touch with a child. The court orders video calls at fixed times, and we help the parent set a routine that works across time zones.

Mutual consent divorce in about 30 days. Under Indian divorce law, where the court waives the six-month cooling-off period, a mutual consent divorce can be completed in about 30 days. In special cases, a divorce can be filed before one year of marriage, with special circumstances, by using Section 14 of the Hindu Marriage Act. Read more about mutual consent divorce.
