NRI Divorce Lawyer For Delhi Courts
Matrimonial disputes in the capital are decided by the family courts attached to the district court complexes, with appeals going to the Delhi High Court and, in the end, to the Supreme Court of India. The complex that has authority over your case is decided by the address of the parties and the place where the marriage was held or where you last lived together.
NRI Divorce matters need an advocate who knows both the law and the daily working of the court. Advocate Manish Kumar of S.S Associates practises from Chamber No. 551-B at the Dwarka Courts and appears before the Delhi courts, advising clients in Hindi and English and keeping every consultation confidential.
The Legal Framework
Many Indian marriages involve a spouse living abroad, and the legal problems are different: which country’s court has jurisdiction, whether a foreign decree is valid in India and how notice is served across borders. Indian courts follow Section 13 of the Code of Civil Procedure, and in Y. Narasimha Rao v. Y. Venkata Lakshmi the Supreme Court said a foreign divorce decree is recognised only if it was passed by a competent court, on the merits and on grounds available under the law that governed the marriage, and without fraud.
An NRI can file in India if the marriage was solemnised here or the parties last lived together here. Appearances may be made through a registered power of attorney, though the court can insist on personal presence for certain statements. Video conferencing is widely used in Delhi courts for NRI litigants, subject to the judge’s directions.
Beyond divorce, NRI cases usually raise questions of child custody and return, maintenance, passports, lookout circulars and the validity of a divorce already obtained overseas. We coordinate with foreign counsel where an overseas proceeding is already pending.
How A NRI Divorce Case Proceeds
- Initial consultation by phone or video to understand the country of residence, the marriage details and any proceedings abroad.
- Choice of the forum in India and preparation of the petition, with documents attested as required.
- Execution of a power of attorney, attested by the Indian embassy or notarised with apostille, where the NRI cannot travel.
- Service of notice abroad and management of the respondent’s response.
- Interim relief for maintenance and custody, with a plan for virtual appearances.
- Mediation and settlement discussions, which can often be held online.
- Final decree, and legal steps to have it recognised in the country of residence.
Documents We Ask You To Prepare
- Passport and visa or residence proofs
- Marriage certificate and proofs of marriage in India or abroad
- Copies of any foreign court orders or pleadings
- Details of employment and income abroad
- Child’s passport and custody documents
- Apostilled or embassy-attested power of attorney
Timeline And What Affects It
NRI cases take longer than domestic ones because of service of notice, time zones and attestation. A mutual consent case with video appearance can be completed in a few months, while a contested NRI case can run several years. A good plan for appearances cuts delay considerably.
Practising Before Delhi Courts
Delhi family courts follow the Family Courts Act, 1984, which requires the court to try for reconciliation and to refer suitable cases to mediation before a full trial. Hearings are listed through the court cause list each morning, so your advocate has to be present and prepared at short notice.
Illustrative Situations
These are general illustrations of the kinds of problems we are asked about. They are not real client cases and every matter turns on its own facts.
- Spouses living in separate neighbourhoods: The husband lives in South Delhi and the wife in North Delhi. We identify the court with territorial jurisdiction and the one most practical for both parties.
- A long-pending case needing direction: A matrimonial petition has been listed for years with no progress. We study the order sheet to see what is holding it up and which application can restart it.
- An urgent interim need: A wife with a young child has no income and needs maintenance quickly. We file an interim application with her income and expense affidavit.

Frequently Asked Questions
Your Questions Answered
Straight answers to what clients ask us most often.
Ask Us DirectlyCan I file for divorce in India while living abroad?
Yes, if the Indian court has jurisdiction, for instance because the marriage took place here or the couple last lived together here. You can act through a power of attorney and attend by video where allowed.
Is my foreign divorce valid in India?
It is recognised only if it meets the tests in Section 13 of the CPC, as explained in Y. Narasimha Rao v. Y. Venkata Lakshmi. A decree obtained without proper notice or on non-Indian grounds may not be accepted.
Do I have to travel to India for every hearing?
No. Many appearances can be through your advocate, and the court may permit video conferencing. Some statements may still require your personal presence.
What about my children living abroad?
Custody is decided on the welfare of the child. We advise on custody claims, visitation and return orders, working with counsel overseas where needed.
Can you help with a power of attorney?
Yes. We draft it and explain the attestation steps required by the Indian embassy or by apostille.
Which court will hear my nri divorce case if I live near the Delhi courts?
The complex that has authority over your case is decided by the address of the parties and the place where the marriage was held or where you last lived together.
Do you appear before Delhi Courts?
Yes. Advocate Manish Kumar appears before the Delhi courts and the other Delhi courts, with chambers at Dwarka Court, Sector 10, New Delhi 110075.
