NRI Divorce Lawyer For Saket Courts

The Saket District Courts, on Press Enclave Road, serve the South and South-East districts of Delhi and house a large number of family courts. Residents of Saket, Malviya Nagar, Greater Kailash, Defence Colony, Lajpat Nagar, Hauz Khas and the surrounding colonies normally fall under this complex.

NRI Divorce matters need an advocate who knows both the law and the daily working of the court. Advocate Manish Kumar of S.S Associates practises from Chamber No. 551-B at the Dwarka Courts and appears before Saket, advising clients in Hindi and English and keeping every consultation confidential.

The Legal Framework

Many Indian marriages involve a spouse living abroad, and the legal problems are different: which country’s court has jurisdiction, whether a foreign decree is valid in India and how notice is served across borders. Indian courts follow Section 13 of the Code of Civil Procedure, and in Y. Narasimha Rao v. Y. Venkata Lakshmi the Supreme Court said a foreign divorce decree is recognised only if it was passed by a competent court, on the merits and on grounds available under the law that governed the marriage, and without fraud.

An NRI can file in India if the marriage was solemnised here or the parties last lived together here. Appearances may be made through a registered power of attorney, though the court can insist on personal presence for certain statements. Video conferencing is widely used in Delhi courts for NRI litigants, subject to the judge’s directions.

Beyond divorce, NRI cases usually raise questions of child custody and return, maintenance, passports, lookout circulars and the validity of a divorce already obtained overseas. We coordinate with foreign counsel where an overseas proceeding is already pending.

How A NRI Divorce Case Proceeds

  1. Initial consultation by phone or video to understand the country of residence, the marriage details and any proceedings abroad.
  2. Choice of the forum in India and preparation of the petition, with documents attested as required.
  3. Execution of a power of attorney, attested by the Indian embassy or notarised with apostille, where the NRI cannot travel.
  4. Service of notice abroad and management of the respondent’s response.
  5. Interim relief for maintenance and custody, with a plan for virtual appearances.
  6. Mediation and settlement discussions, which can often be held online.
  7. Final decree, and legal steps to have it recognised in the country of residence.

Documents We Ask You To Prepare

  • Passport and visa or residence proofs
  • Marriage certificate and proofs of marriage in India or abroad
  • Copies of any foreign court orders or pleadings
  • Details of employment and income abroad
  • Child’s passport and custody documents
  • Apostilled or embassy-attested power of attorney

Timeline And What Affects It

NRI cases take longer than domestic ones because of service of notice, time zones and attestation. A mutual consent case with video appearance can be completed in a few months, while a contested NRI case can run several years. A good plan for appearances cuts delay considerably.

Practising Before Saket Courts

Saket has a number of family courts, a court-annexed mediation centre and a counselling unit, so many contested cases are referred to mediation early. The complex is connected by the Saket station on the Yellow Line and by road from the Mehrauli-Badarpur corridor.

Practical tip. Mediation referral is common at Saket. We prepare clients for mediation sessions so that they enter with realistic and documented positions.

Illustrative Situations

These are general illustrations of the kinds of problems we are asked about. They are not real client cases and every matter turns on its own facts.

  • A couple from Greater Kailash: The spouses are well-off and dispute the division of jointly bought property. A petition and an application for interim relief are listed at Saket.
  • A wife in Malviya Nagar seeking maintenance: She has not worked since marriage and her husband has stopped paying household expenses. An application under the Hindu Marriage Act is filed at Saket.
  • A husband from Hauz Khas facing a cruelty petition: His wife has filed for divorce on grounds of cruelty. We study the allegations and plan a written statement with supporting documents.
Please note. This page gives general information and is not a substitute for advice on your own facts. Laws and court procedures change, so please speak to an advocate before you act.

Your Questions Answered

Straight answers to what clients ask us most often.

Ask Us Directly
Can I file for divorce in India while living abroad?

Yes, if the Indian court has jurisdiction, for instance because the marriage took place here or the couple last lived together here. You can act through a power of attorney and attend by video where allowed.

Is my foreign divorce valid in India?

It is recognised only if it meets the tests in Section 13 of the CPC, as explained in Y. Narasimha Rao v. Y. Venkata Lakshmi. A decree obtained without proper notice or on non-Indian grounds may not be accepted.

Do I have to travel to India for every hearing?

No. Many appearances can be through your advocate, and the court may permit video conferencing. Some statements may still require your personal presence.

What about my children living abroad?

Custody is decided on the welfare of the child. We advise on custody claims, visitation and return orders, working with counsel overseas where needed.

Can you help with a power of attorney?

Yes. We draft it and explain the attestation steps required by the Indian embassy or by apostille.

Which court will hear my nri divorce case if I live near Saket?

Residents of Saket, Malviya Nagar, Greater Kailash, Defence Colony, Lajpat Nagar, Hauz Khas and the surrounding colonies normally fall under this complex.

Do you appear before Saket Courts?

Yes. Advocate Manish Kumar appears before Saket and the other Delhi courts, with chambers at Dwarka Court, Sector 10, New Delhi 110075.
