Alimony Lawyer For Saket Courts

The Saket District Courts, on Press Enclave Road, serve the South and South-East districts of Delhi and house a large number of family courts. Residents of Saket, Malviya Nagar, Greater Kailash, Defence Colony, Lajpat Nagar, Hauz Khas and the surrounding colonies normally fall under this complex.

Divorce Maintenance And Alimony matters need an advocate who knows both the law and the daily working of the court. Advocate Manish Kumar of S.S Associates practises from Chamber No. 551-B at the Dwarka Courts and appears before Saket, advising clients in Hindi and English and keeping every consultation confidential.

The Legal Framework

Maintenance is financial support paid to a spouse, or children, who cannot support themselves. Under the Hindu Marriage Act, Section 24 lets the court order interim maintenance and litigation expenses while a case is pending, and Section 25 allows permanent alimony when the decree is passed or later. A claim can also be made under Section 144 of the Bharatiya Nagarik Suraksha Sanhita, 2023, which replaced Section 125 of the Code of Criminal Procedure, and under the Hindu Adoptions and Maintenance Act, 1956.

There is no fixed formula. Courts look at the income and property of both spouses, the standard of living during the marriage, the wife’s education and earning capacity, the number of dependants, the length of the marriage and any liabilities. In Rajnesh v. Neha the Supreme Court directed both sides to file a detailed affidavit of assets and liabilities so the court can decide on facts and not guesswork.

A husband may also have a genuine case for reduction or against an inflated claim. We examine pay records, business accounts and lifestyle evidence, and we present a balanced picture. Where possible, maintenance is settled as a one-time payment, which removes years of future litigation for both sides.

How A Divorce Maintenance And Alimony Case Proceeds

  1. Review of both parties’ income, expenses, property and the history of the marriage.
  2. Preparation of the affidavit of assets, income and liabilities in the format directed by the Supreme Court.
  3. Filing of the application for interim maintenance, litigation expenses or permanent alimony.
  4. Hearing on interim relief, usually decided early in the case.
  5. Evidence on income and expenses where the figures are disputed.
  6. Final order, and if needed, execution proceedings to recover arrears.

Documents We Ask You To Prepare

  • Income tax returns and salary slips for the last three years
  • Bank statements and investment records
  • Property papers and details of loans
  • Proof of expenses for children and household
  • Medical or educational records showing dependency
  • Marriage certificate and any earlier court orders

Timeline And What Affects It

Interim maintenance is normally decided within a few months of the application. Permanent alimony is fixed at the end of the case, or earlier when the parties settle. Recovery of arrears can take further time, and we advise on enforcement options where payments stop.

Practising Before Saket Courts

Saket has a number of family courts, a court-annexed mediation centre and a counselling unit, so many contested cases are referred to mediation early. The complex is connected by the Saket station on the Yellow Line and by road from the Mehrauli-Badarpur corridor.

Practical tip. Mediation referral is common at Saket. We prepare clients for mediation sessions so that they enter with realistic and documented positions.

Illustrative Situations

These are general illustrations of the kinds of problems we are asked about. They are not real client cases and every matter turns on its own facts.

  • A couple from Greater Kailash: The spouses are well-off and dispute the division of jointly bought property. A petition and an application for interim relief are listed at Saket.
  • A wife in Malviya Nagar seeking maintenance: She has not worked since marriage and her husband has stopped paying household expenses. An application under the Hindu Marriage Act is filed at Saket.
  • A husband from Hauz Khas facing a cruelty petition: His wife has filed for divorce on grounds of cruelty. We study the allegations and plan a written statement with supporting documents.
Please note. This page gives general information and is not a substitute for advice on your own facts. Laws and court procedures change, so please speak to an advocate before you act.

Frequently Asked Questions

Your Questions Answered

Straight answers to what clients ask us most often.

Ask Us Directly
How is alimony calculated?

There is no formula. Courts weigh both spouses’ incomes and assets, the standard of living, the duration of the marriage, children and earning capacity, and they rely on the affidavits filed by both sides.

Can a working wife claim maintenance?

Yes, if her income is not enough to support herself at a level reasonably close to her married life. A working wife’s salary is considered, but it does not automatically bar a claim.

Can a husband claim maintenance?

Under Sections 24 and 25 of the Hindu Marriage Act the law is gender neutral, so a husband without independent income can apply, although such orders are less common.

What happens if maintenance is not paid?

Arrears can be recovered through execution proceedings, and non-payment can lead to attachment of salary or property and, in some cases, imprisonment for default.

Is a one-time settlement better than monthly payments?

Often yes, as it ends future disputes. Whether it suits you depends on the amount, the security of payment and your circumstances.

Which court will hear my divorce maintenance and alimony case if I live near Saket?

Residents of Saket, Malviya Nagar, Greater Kailash, Defence Colony, Lajpat Nagar, Hauz Khas and the surrounding colonies normally fall under this complex.

Do you appear before Saket Courts?

Yes. Advocate Manish Kumar appears before Saket and the other Delhi courts, with chambers at Dwarka Court, Sector 10, New Delhi 110075.
