Alimony Lawyer For Delhi District Courts
Delhi has several district court complexes, each handling the matrimonial cases of the neighbourhoods that fall within its jurisdiction. Those complexes are at Tis Hazari, Patiala House, Rohini, Dwarka, Saket, Karkardooma and Rouse Avenue. Which complex hears your case depends mainly on where you and your spouse live, where you last lived together as a couple and where the marriage took place.
Divorce Maintenance And Alimony matters need an advocate who knows both the law and the daily working of the court. Advocate Manish Kumar of S.S Associates practises from Chamber No. 551-B at the Dwarka Courts and appears before the Delhi district courts, advising clients in Hindi and English and keeping every consultation confidential.
The Legal Framework
Maintenance is financial support paid to a spouse, or children, who cannot support themselves. Under the Hindu Marriage Act, Section 24 lets the court order interim maintenance and litigation expenses while a case is pending, and Section 25 allows permanent alimony when the decree is passed or later. A claim can also be made under Section 144 of the Bharatiya Nagarik Suraksha Sanhita, 2023, which replaced Section 125 of the Code of Criminal Procedure, and under the Hindu Adoptions and Maintenance Act, 1956.
There is no fixed formula. Courts look at the income and property of both spouses, the standard of living during the marriage, the wife’s education and earning capacity, the number of dependants, the length of the marriage and any liabilities. In Rajnesh v. Neha the Supreme Court directed both sides to file a detailed affidavit of assets and liabilities so the court can decide on facts and not guesswork.
A husband may also have a genuine case for reduction or against an inflated claim. We examine pay records, business accounts and lifestyle evidence, and we present a balanced picture. Where possible, maintenance is settled as a one-time payment, which removes years of future litigation for both sides.
How A Divorce Maintenance And Alimony Case Proceeds
- Review of both parties’ income, expenses, property and the history of the marriage.
- Preparation of the affidavit of assets, income and liabilities in the format directed by the Supreme Court.
- Filing of the application for interim maintenance, litigation expenses or permanent alimony.
- Hearing on interim relief, usually decided early in the case.
- Evidence on income and expenses where the figures are disputed.
- Final order, and if needed, execution proceedings to recover arrears.
Documents We Ask You To Prepare
- Income tax returns and salary slips for the last three years
- Bank statements and investment records
- Property papers and details of loans
- Proof of expenses for children and household
- Medical or educational records showing dependency
- Marriage certificate and any earlier court orders
Timeline And What Affects It
Interim maintenance is normally decided within a few months of the application. Permanent alimony is fixed at the end of the case, or earlier when the parties settle. Recovery of arrears can take further time, and we advise on enforcement options where payments stop.
Practising Before Delhi District Courts
Each complex has family courts staffed by dedicated judges, along with a mediation centre and a counselling section that parties are usually sent to before evidence begins. Because the complexes are far apart, the first practical step is to confirm the right court for your address before any petition is drafted.
Illustrative Situations
These are general illustrations of the kinds of problems we are asked about. They are not real client cases and every matter turns on its own facts.
- A couple living in two different districts: The wife lives with her parents in West Delhi while the husband stays in the East. We examine where the last matrimonial home was and where each person now lives before choosing the forum.
- A marriage solemnised in Delhi, spouses now elsewhere: The marriage took place in a Delhi banquet hall, but both spouses now work in other cities. Delhi courts may still have jurisdiction because the marriage was solemnised here.
- A transfer of an existing case: A case was filed in a district that has become inconvenient for one party. We evaluate whether a transfer application is realistic and what the court looks for.

Frequently Asked Questions
Your Questions Answered
Straight answers to what clients ask us most often.
Ask Us DirectlyHow is alimony calculated?
There is no formula. Courts weigh both spouses’ incomes and assets, the standard of living, the duration of the marriage, children and earning capacity, and they rely on the affidavits filed by both sides.
Can a working wife claim maintenance?
Yes, if her income is not enough to support herself at a level reasonably close to her married life. A working wife’s salary is considered, but it does not automatically bar a claim.
Can a husband claim maintenance?
Under Sections 24 and 25 of the Hindu Marriage Act the law is gender neutral, so a husband without independent income can apply, although such orders are less common.
What happens if maintenance is not paid?
Arrears can be recovered through execution proceedings, and non-payment can lead to attachment of salary or property and, in some cases, imprisonment for default.
Is a one-time settlement better than monthly payments?
Often yes, as it ends future disputes. Whether it suits you depends on the amount, the security of payment and your circumstances.
Which court will hear my divorce maintenance and alimony case if I live near the Delhi district courts?
Which complex hears your case depends mainly on where you and your spouse live, where you last lived together as a couple and where the marriage took place.
Do you appear before Delhi District Courts?
Yes. Advocate Manish Kumar appears before the Delhi district courts and the other Delhi courts, with chambers at Dwarka Court, Sector 10, New Delhi 110075.
