Domestic Violence Lawyer For Delhi District Courts

Delhi has several district court complexes, each handling the matrimonial cases of the neighbourhoods that fall within its jurisdiction. Those complexes are at Tis Hazari, Patiala House, Rohini, Dwarka, Saket, Karkardooma and Rouse Avenue. Which complex hears your case depends mainly on where you and your spouse live, where you last lived together as a couple and where the marriage took place.

Domestic Violence matters need an advocate who knows both the law and the daily working of the court. Advocate Manish Kumar of S.S Associates practises from Chamber No. 551-B at the Dwarka Courts and appears before the Delhi district courts, advising clients in Hindi and English and keeping every consultation confidential.

The Legal Framework

The Protection of Women from Domestic Violence Act, 2005 gives a woman civil remedies against abuse in a domestic relationship. Abuse is defined widely and includes physical, sexual, verbal and emotional abuse as well as economic abuse such as denial of money, food or the shared home.

A complaint is made to a Magistrate, often with the help of a Protection Officer. The court can pass protection orders, residence orders that stop a woman being thrown out of her shared household, monetary relief, custody orders and compensation. Interim and ex parte orders can be obtained in urgent cases.

The Act works alongside criminal law. Cruelty by a husband or relatives is an offence under Section 85 of the Bharatiya Nyaya Sanhita, which replaced Section 498A of the IPC, and the Supreme Court in Arnesh Kumar v. State of Bihar required police to follow safeguards before arrest. We act for women who need protection, and also for men and families who face allegations and need a careful, factual defence.

How A Domestic Violence Case Proceeds

  1. A confidential conversation in which we understand the incidents and identify immediate safety needs.
  2. Collection of evidence such as medical reports, photos, messages and witness details.
  3. Preparation of the domestic incident report or direct application before the Magistrate.
  4. Application for interim protection, residence and maintenance orders.
  5. Hearings with notice to the respondent, followed by a reply and evidence.
  6. Final order, and enforcement action if the order is breached.

Documents We Ask You To Prepare

  • Identity and address proofs
  • Medical records and photographs of injuries
  • Messages, emails and call records
  • Police complaints or DD entries, if any
  • Proof of marriage and shared household
  • Details of income and expenses

Timeline And What Affects It

First hearings are generally listed within weeks of filing and urgent interim relief can be sought immediately. Final orders can take months or longer, depending on the evidence and how the other side responds.

Practising Before Delhi District Courts

Each complex has family courts staffed by dedicated judges, along with a mediation centre and a counselling section that parties are usually sent to before evidence begins. Because the complexes are far apart, the first practical step is to confirm the right court for your address before any petition is drafted.

Practical tip. A petition filed in the wrong district can be returned or transferred, which costs months. We check territorial jurisdiction before we draft a single page.

Illustrative Situations

These are general illustrations of the kinds of problems we are asked about. They are not real client cases and every matter turns on its own facts.

  • A couple living in two different districts: The wife lives with her parents in West Delhi while the husband stays in the East. We examine where the last matrimonial home was and where each person now lives before choosing the forum.
  • A marriage solemnised in Delhi, spouses now elsewhere: The marriage took place in a Delhi banquet hall, but both spouses now work in other cities. Delhi courts may still have jurisdiction because the marriage was solemnised here.
  • A transfer of an existing case: A case was filed in a district that has become inconvenient for one party. We evaluate whether a transfer application is realistic and what the court looks for.
Please note. This page gives general information and is not a substitute for advice on your own facts. Laws and court procedures change, so please speak to an advocate before you act.
