Domestic Violence Lawyer For Delhi High Court
The Delhi High Court, on Sher Shah Road, hears appeals against family court orders, writ petitions and a range of matrimonial matters arising from Delhi. An appeal from a family court decree or an interim order can be filed before the High Court within the time allowed by law, which is generally 30 days.
Domestic Violence matters need an advocate who knows both the law and the daily working of the court. Advocate Manish Kumar of S.S Associates practises from Chamber No. 551-B at the Dwarka Courts and appears before the Delhi High Court, advising clients in Hindi and English and keeping every consultation confidential.
The Legal Framework
The Protection of Women from Domestic Violence Act, 2005 gives a woman civil remedies against abuse in a domestic relationship. Abuse is defined widely and includes physical, sexual, verbal and emotional abuse as well as economic abuse such as denial of money, food or the shared home.
A complaint is made to a Magistrate, often with the help of a Protection Officer. The court can pass protection orders, residence orders that stop a woman being thrown out of her shared household, monetary relief, custody orders and compensation. Interim and ex parte orders can be obtained in urgent cases.
The Act works alongside criminal law. Cruelty by a husband or relatives is an offence under Section 85 of the Bharatiya Nyaya Sanhita, which replaced Section 498A of the IPC, and the Supreme Court in Arnesh Kumar v. State of Bihar required police to follow safeguards before arrest. We act for women who need protection, and also for men and families who face allegations and need a careful, factual defence.
How A Domestic Violence Case Proceeds
- A confidential conversation in which we understand the incidents and identify immediate safety needs.
- Collection of evidence such as medical reports, photos, messages and witness details.
- Preparation of the domestic incident report or direct application before the Magistrate.
- Application for interim protection, residence and maintenance orders.
- Hearings with notice to the respondent, followed by a reply and evidence.
- Final order, and enforcement action if the order is breached.
Documents We Ask You To Prepare
- Identity and address proofs
- Medical records and photographs of injuries
- Messages, emails and call records
- Police complaints or DD entries, if any
- Proof of marriage and shared household
- Details of income and expenses
Timeline And What Affects It
First hearings are generally listed within weeks of filing and urgent interim relief can be sought immediately. Final orders can take months or longer, depending on the evidence and how the other side responds.
Practising Before Delhi High Court
The High Court looks at whether the family court applied the law correctly, so appeals focus on the record, legal questions and the reasoning of the order. The court complex is reached from Pragati Maidan Metro station and by road along Sher Shah Road.
Illustrative Situations
These are general illustrations of the kinds of problems we are asked about. They are not real client cases and every matter turns on its own facts.
- An appeal against a divorce decree: A husband’s divorce petition is dismissed by the family court. We study the judgment for errors of law and file an appeal before the High Court.
- A challenge to interim maintenance: A husband believes the interim maintenance fixed against him is excessive. We examine the order and the income evidence, and consider a revision or appeal.
- A matter of urgent quashing: A client seeks to quash a criminal case after a settlement. We prepare a petition supported by the settlement terms.
