Court Marriage Advocate In Delhi

A court marriage is a civil marriage registered under the Special Marriage Act, 1954. It needs no religious ceremony, priests or large gathering, and it is open to any two adults who meet the legal conditions, whatever their religion or caste. It is the usual route for interfaith couples and for couples who want a simple, legally secure marriage.

Advocate Manish Kumar of S.S Associates guides couples through each step in Delhi, from the notice of intended marriage to the marriage certificate, and explains how the process interacts with family opposition, name changes and later documentation.

Who Can Marry Under The Special Marriage Act

Under Section 4 of the Act, neither party may have a living spouse at the time of marriage, both must be capable of giving valid consent, the man must be at least 21 years old and the woman at least 18, and the parties must not fall within the prohibited degrees of relationship unless a custom allows it.

Both parties must also have been residents of the district where the notice is given for at least thirty days before it is filed.

Step By Step Procedure

  1. Notice of intended marriage: the couple gives written notice to the Marriage Officer of the district where at least one of them has lived for thirty days.
  2. Publication: the notice is displayed for thirty days so that objections, if any, can be raised.
  3. Objections: if an objection is raised, the Marriage Officer inquires into it before proceeding.
  4. Solemnisation: after the period ends, the marriage is solemnised in the presence of three witnesses and the parties sign the declarations.
  5. Certificate: the Marriage Officer issues the marriage certificate, which is conclusive proof of the marriage.

Documents Normally Required

  • Application form and notice signed by both parties
  • Proof of age such as a birth certificate or school leaving certificate
  • Proof of residence for both parties
  • Passport-size photographs
  • Affidavits of marital status, stating that neither is already married
  • Divorce decree or death certificate of a former spouse, if applicable
  • Three witnesses with identity proof

Requirements differ slightly between offices, so we confirm the current checklist before you file.

Can A Couple Marry Without Family Consent?

Adults have a legal right to choose their spouse, and the Supreme Court has repeatedly affirmed this. The Marriage Officer does not need family consent. Where a couple fears harassment, we advise on lawful protective steps, including a request for police protection to the High Court in genuine cases.

Court Marriage And Converting An Existing Marriage

A couple who married in a religious ceremony can also register that marriage under the Special Marriage Act, which gives it a civil certificate for use in visas, passports and name changes. We help with this registration as well.

After The Marriage

A marriage certificate is used to update the name on identity records, to apply for a spouse visa, to add a spouse to insurance and to open joint accounts. If the marriage later breaks down, divorce under the Special Marriage Act follows its own provisions, which we also handle.

Please note. Procedures and fees differ between Marriage Officers and can change. This page is general information, not advice on your own facts.
